RECENT SETTLEMENTS AND VERDICTS
Settlement Amount: $4,000,000 – Maury County. Two adults and a child were injured when they were hit at an intersection by a speeding and intoxicated minor. One victim, a registered nurse, suffered the most serious injuries, including multiple orthopedic injuries, scarring and a "closed head injury".
Verdict Amount: $1,200,000 - U.S. District Court, Middle District of TN. This Federal Court case against a large multi-national corporation was tried to a jury by lead counsel Robert L. Whitaker. Plaintiffs have appealed on punitive damages.
Judgment Amount: $1,000,000 (plus confidential settlement) – Davidson County. Client was a passenger in a vehicle with husband and children and was struck by a vehicle in the rear by a driver under the influence. The drunk driver was involved in a high speed chase with Metro Police. Suit was filed against the driver and the police department. Judgment was obtained against the drunk driver and Plaintiffs entered into a confidential settlement with Metro.
Settlement Amount: $425,000 (at mediation) – Davidson County. Plaintiff tripped and fell due to a dangerous condition created by apartment complex workers. Plaintiff's knee was seriously injured and required multiple surgeries with medical expenses exceeding $399,000. The Defendant denied liability and claimed that the dangerous condition was open and obvious.
Settlement Amount: $741,500 – U.S. District Court, Middle District of TN. Plaintiff was a passenger in a vehicle that was rear-ended by a tractor trailer causing the driver to lose control of the vehicle. Plaintiff was seriously hurt and had over $240,000 in medical bills.
Judgment Amount: $155,000 (offer before trial was $0) – Jury Trial - Davidson County. Plaintiff was injured in an auto accident and had surgery on his back. Defendant claimed all injuries were pre-existing since Plaintiff had prior back surgeries.
Settlement Amount: $550,000 (at mediation) – Rutherford County. Plaintiff was riding his motorcycle when the driver of a company pickup truck turned left in front of him at an intersection and hit the motorcycle head on. Plaintiff suffered multiple injuries with medical bills exceeding $220,000. Suit was filed against the driver and the driver's company.
Judgment Amount: $15,000,000 (judgment by default after court hearing and testimony) – Lewis County. Husband and wife were hit on a motorcycle by a drunk driver. The husband was killed and the wife is permanently injured and in a wheelchair.
Settlement Amount: $450,000 – Wilson County. This was a fatal jailhouse beating by corrections officers. Robert L. Whitaker personally interviewed numerous witnesses prior to criminal charges being filed and provided these videotaped interviews to the FBI. This led to a settlement and conviction.
Judgment Amount: $385,000 – Jury Trial - Bedford County. Plaintiff was driving to work when a tractor trailer driver heading the opposite direction took a curve too fast and rolled over onto Plaintiff's vehicle. Plaintiff suffered a closed head injury and had less than $20,000 in medical bills. NOTE: Plaintiff had been represented in the same case by another law firm who had the case for five years without going to trial. Robert L. Whitaker then took over and the case went to trial within the next year. The offer prior to trial was $60,000. **THIS WAS THE HIGHEST JURY VERDICT IN BEDFORD COUNTY IN THE SEVEN PRECEDING YEARS.**
